Artwork Terms of Service, Guarantee & Privacy Policy

Welcome to Kelly Darke’s Gallery! I’m so grateful to share my artwork with you. Please take a moment to review my terms of service, guarantee, and privacy policy to ensure a smooth and enjoyable experience.

1. Copyright & Usage

All artwork, including but not limited to weavings, paintings, prints, digital illustrations, and handmade crafts, is the intellectual property of Kelly Darke and protected by copyright laws. Purchasing an artwork does not grant reproduction rights or permission to use the image for commercial purposes without explicit written consent. I kindly ask that you respect the creative integrity of my work.

2. Order Processing & Shipping

Each piece is handled with care and packaged to ensure its safe arrival. Please allow 5 business days for processing before shipment. Delivery times may vary based on location and carrier services.

Once your order is shipped, you will receive a confirmation email with tracking information. I am not responsible for delays caused by the shipping carrier, but I am happy to assist in resolving any issues that may arise.

3. Refunds & Exchanges

I want you to love your artwork! However, due to the unique and handmade nature of my pieces, all sales are final.

Limited exceptions for refunds or exchanges may apply in the case of:

• Damage during shipping (must be reported within 7 days of delivery with photos of the damage)
• Incorrect item received

If you believe you qualify for a return or exchange, please contact me at Kelly@KellyDarke.com within 7 days of receiving your order. Approved returns must be sent back in their original condition and packaging.

4. Custom & Commissioned Artwork

Custom and commissioned pieces are made with care to align with your vision. All commissioned orders require a non-refundable 50% deposit due at the time of order and the remainder to be paid upon completion of the work. Due to the nature of personalized artwork, all custom sales are final. If there is an issue with your commissioned piece, I encourage open communication, and I’ll do my best to ensure you are satisfied with the final result.

5. Digital Artwork & Downloads

For digital purchases, files are provided for personal use only. Redistribution, resale, or modification for commercial purposes is strictly prohibited. If you have any questions about proper usage, don’t hesitate to reach out.

6. Privacy Policy

I respect your privacy and am committed to protecting your personal information. When you make a purchase or sign up for my newsletter, I collect necessary details such as your name, email, and shipping address to fulfill your order and keep you updated.
